It is a legal obligation for people who want to work legally in Turkey to have a valid work permit. According to International Labor Law No. 6735, a foreigner cannot legally work in Turkey without a work permit. It is also required for these employees to register a statement of employment for the Social Security Institution (SGK). There are also some legal procedures to make the foreigner's SGK entries who have a work permit correctly. Recruitment Notice Periods
Unless otherwise stated in the international agreements to which Turkey is a party, foreigners who will start working independently or independently in Turkey must first obtain a valid work permit.
Depending on certain force majeure, work permits can also be given after starting work. The relevant authority is informed before starting to work, provided that the working period does not exceed one month and that the ministry's approval is obtained.
Within 45 days from the start date of the work permit in the work permit, within 45 days from the date of notification of the work permit to the employer in case the work permit date is different from the date of notification to the employer, if the insured statement of employment is submitted to the SGK, the notice is given within the legal time limit. If the declaration is submitted in full within this 45-day period, the condition that the date of employment and the date of the declaration shall not be sought. Administrative fines are applied for job entry notifications that are not made on time.
Residence Permit Procedure
According to the International Labor Law No. 6735, which is being implemented in Turkey, foreigners holding a valid work permit in Turkey are also considered as residence permit holders. Foreigners must apply to the provincial police directorates to obtain a residence permit with a work permit within 30 days at the latest from the date they receive their work permit cards in Turkey. After the application, there is a 15-day period for the approval of the residence permit. In addition, residence permits that the foreigner does not receive within 1 month are canceled as of the application date.
Minimum Wages for Foreigners
First of all, let us remind you that the minimum wages vary according to the business lines and positions that foreigners will legally work in. As of 2021, the minimum wage applied in the country is 3.577.50 TL gross and 2.825.90 TL net. For example, salaries may vary 1.5 times the minimum wage for those working in the export, sales, and marketing departments, 4 times the minimum wage for engineers and architects, and 6.5 times the minimum wage for senior managers and pilots.
